Litigation Process

After you have hired a lawyer there is a lawsuit process that your lawyer will follow. After first filing a claim at the courthouse, the defendant named will have 30 days to provide an answer. The reply is either denying, or admitting the claim. From there the lawsuit begins, and each lawyer will have access to information the other side has gathered concerning the case. You will have to answer a list of written questions under oath, where you will provide your answers to the defendant. After the written questions have been covered, you will need to answer questions in person, with your lawyer present, and under oath. This process is called the deposition. Finally after this process draws to a close, the trial date will be set. This could take several months, or several years, often depending on the medical condition of the plaintiff. The plaintiff will have access to your medical documents through the trial.

Because of the large magnitude of patients suffering from the neglectful actions of these companies, our country is scrambling to find a more efficient way of handling the overwhelming flood of lawsuits in our court system.
